Can you fail a 2012 car on front fog light?

My 2011 Mini Cooper failed it's MOT today due to one of the front fog lights not working. They've put it down as a major defect:



"Offside Front Position lamp not working (4.2.1 (a) (ii))"



Am I wrong to think that they shouldn't even be inspecting front fog lights on a 2011 car and do I have a right to tell them to pass it (there were no other defects) and I'll get it fixed elsewhere as thought £162 was a bit steep? I noticed there was sometimes a bulb lamp warning when I start the car but didn't think that was necessarily a failure either.
