Mechanical/hydraulic brake checks

So yes I'm still finding my feet working through all the new testing regulations. I tested a Skoda 2008 diesel model this afternoon and when I was sat in the car depressing the foot brake (engine not running) I felt the pedal reserve travel reducing, thus thinking the brakes have a leak somewhere!

Turned out under the bonnet that the ABS Modulator was leaking, actually corroded. So when I got to the point of entering results looking through the brakes section, I could not find anything to say that the brakes were in a dangerous condition and should not be driven, however I can fail a tyre below 1.6 mm and it is considered dangerous, but a tyre at 1.65 mm is a pass and advise not dangerous to drive?

Somebody in cloud cuckoo land needs a wake up call.

At least two pages of suggestions I have now lined up for the next council meeting, that is when they find the time to face us again.
