Tested a car 3month ago and need advice!!

Personally I know it is a worry that she is threatening you with legal action but I can't see how you would be responsible. If she has just bought the vehicle surely it is her responsibility to get the vehicle checked by a professional person before she parted with her cash. What mileage has been covered within the 3 months? Who is to say that the garage that she took it too haven't ripped her off? It doesn't say much considering the drive shaft sheared off a few days later. But that could all be hearsay, sometimes unfortunately people try it on and it's a sad part of modern life.once she had a concern with said defects she shouldn't have had the defects repaired she should of brought the vehicle to you for you to have a look and address any problems. As she hasn't done that I can't see if vosa would entertain in a appeal . They would probably look at it but since Joebblogs and the carpet fitter have had there hands on it I can't see you having a real problem. It is only my opinion and if it where me I would let her appeal.

Well, we all sympathise with the owner but there are some questions that need to be asked here.

Normally when this sort of thing happens those that feel aggrieved look to apportion blame elsewhere, usually because it is they that are staring a repair bill in the face. And that is human nature. But that hardly means you are at fault, and if that is what she believes, she will have to prove it (and be careful along the way that she does not slander or libel you.)

Initially she should have given you the opportunity to investigate the allegations. Having it repaired by another garage and expecting you to pay will not hold-up, and I speak here from first-hand experience!
Invite her to appeal by all means. (although it’s probably too late now) And, out of interest, is the other/repairing garage an MoT test station? Even if they are, some of the items cited will have been subjective judgements.

Doubtless we’ve all seen stuff like this and if it is your first case, chances are it won’t be your last. If you are right, stand your ground.

If she insists in taking you to court, ask for copies of everything (from the other garage/s etc.) in advance and prepare well in advance. Take copies of all your doc’s too and be prepared to be thoroughly open and honest. Be ruthless too, look to take the other side apart in a calm demolition exercise using every scrap of evidence at your disposal. But be ready for the unexpected. Whether or not you win, or what you may, or may not get back in costs will depend on what happens on the day. Assume nothing.

It’s a real pain, but life’s like that.

If I were in your position, I would feel quietly confident.


P.S. When the time is right, if I were you, I would be asking for a look at ALL of the displaced parts too!
