Tyre tear pass or fail

If you take into consideration that the cut is as you describe one of several, then the pattern may suggest an issue regarding the breakdown in the structure of the tyre, and a possibility of a fail if this is your overall assessment , a single cut of the example shown in the picture if not exposing cords after inspection with a blunt instrument would or should result in a pass and advise.

IF it really doesn't reach the cords (seen or felt) then P&A on it's own, but as described as being one of several present then, in my usual fence sitting way (!), I'm tempted by RFR (d) (ii) with a lump bulge or TEAR caused by seperation or partial failure of it's structure.
But I hate doing this based on photos so I would really want to see it first.

A tear caused by separation or partial failure of the tread is a fail. Do we know if that tear is the worst or least. Do we need cords or ply exposed to fail it for a tear causing separation of the tread, well no, so would DVSA complain if that tyre was failed?

Earlier this year in the trade press a garage repaired a puncture in a tyre for a customer that had already been repaired in different parts of the tread area in about three separate areas, for some reason the tyre decided to deflate on the motorway and caused serious accidents, the forensics decided that the tyre should not have been repaired and that the repair was the cause of the tyre deflating, however they proved that. The point being made, DVSA and VEs advise us to pass and advise a lot I recon, maybe too much, but if this case happened to you and you were charged with manslaughter it might make you think differently. We all have the experiences that customers say yeah I'll get that done before the next mot, so given the tear failure is there I'd use it for that tyre. 

DVSA would not want to stand in a public court and convince the public that the tyre should be put on the road, they'd look a little stupid I'd say.

The rubber isn't the structure, it's just a cover? The tyre wall isn't the tread?

A : Dangerous . B : Major . C : Minor should be ... A : Absolutely Fecked you gonna die if you drive it . B : Nearly fecked and needs sorting out soon as . C : On it's way out and if it still not been sorted out by the next test I gonna laugh at you as I hand you the paper that says FAIL on it .

Because some customers especially traders will argue with the speaking clock.
They would have an argument in a telephone box.
